TAKE ACTION! Have You Phoned Your Lawmakers? They Vote This Week! 

Yes, your State Senator and State Assembly Member are getting ready to vote ON YOUR BEHALF  in Sacramento — as soon as tomorrow.

Homeowners need to PHONE THEIR REPRESENTATIVES IN SACRAMENTO to urge them to VOTE NO  on two bills that void homeowner voting rights and take yet more money out of their wallets.  Both bills are up for a FLOOR VOTE NOW! 

  • AB2159 AB2159 will make it just about impossible for HOA owners to challenge elections in court, because internet voting leaves no paper trail, that is: no signed envelopes or paper ballots that can be collected as evidence and put before the court
  • The bedrock of voting is THE SECRET BALLOT, but experts from CalTech, Massachusetts Institute of Technology (MIT), Secretaries of State from California and Arizona, UC Berkeley School of Public Policy, Verified Voting ALL say that, right now, the technology simply doesn’t exist to make internet voting either secret or secure. 
  • CAI and CACM claim internet voting will save money.  Not true, since the bill requires a HOA to run dual voting systems for homeowners who don’t want to — or can’t — vote online.
  • Phone your State Senator to urge NO! ON AB2159

SB900 is the bill requiring homeowners to MAINTAIN AND REPAIR ALL UTILITY LINES COMING INTO THE SUBDIVISION.  The bill is a huge gift to PG&E and SoCalGas and other utilities, relieving them of the cost of maintaining their own infrastructure. 

  • SB900 lets boards levy “emergency assessments” based on a threat to health and safety – though it sets no standards for declaring the emergency.
  • Boards have sole power to declare the “emergency” and to levy the assessments, which have no dollar cap.  The bill gives homeowners no power to vote.
  • HOWARD JARVIS TAXPAYERS ASSOCIATION opposes SB900, because homeowners have NO VOTE on the assessments.
  • PHONE your Assembly Member and urge NO! on SB900

Key in the ADDRESS FROM WHICH YOU VOTE and your state representatives and phone numbers in SACRAMENTO will be called up.  When you phone, say you are weighing in on state legislation that AFFECTS YOUR RIGHTS AS A HOMEOWNER and urge NO ON AB2159 AND NO ON SB900.
