HOA Industry Attacks Homeowner Voting Rights — Again — with 2024 Legislation

This year in Sacramento the association industry continues its campaign to undermine the voting rights of homeowners. The industry-sponsored bills this session are:

  • AB2159/Maienschein – that would let HOAs run elections over the internet
  • AB2460/Ta that would let the HOA lower the quorum from 33-1/3 to 20% as the minimum required to seat board directors.  Reducing the quorum is to be done AFTER homeowners have voted and WITHOUT individual notice to homeowner voters.

Senator Umberg plans to introduce SB900 that would make homeowners pay for repair and replacement of the infrastructure delivering utilities, i.e. gas, electrical, water, and sewer. 

So why should homeowners care about what HOA bills are awaiting action in Sacramento?

Mostly because these bills – ultimately — affect the wallets of homeowners.  Homeowners in Umberg’s district were hit with a $4800 emergency assessment by the board to fix a gas line and were told they had to pay it within 30 days, though so far no one has been able to determine whether the owners – or the gas company – are legally responsible for the maintenance and repair of the line.  Few of the low-moderate income owners were able to come up with the cash.

What goes on in Sacramento may seem like a mystery – a jumble of lawmakers, committees, hearings, deadlines, floor votes, the Governor’s desk, etc. But the process can be boiled down to some essentials.  So, we’ve posted a new section in the Green Menu of the CCHAL website  called 2024 LEGISLATION.
