TAKE ACTION! AB2159 Cripples Right to Challenge HOA Elections in Small Claims

AB2159 will be voted on TUESDAY THE 30TH AT 9 A.M. IN SACRAMENTO’S JUDICIARY COMMITTEE
AB2159 will make it just about impossible for HOA owners to challenge elections in court.
HOW?
AB2159 lets HOAs run elections by email or through the HOA’s website. INTERNET VOTING DOESN’T USE PAPER BALLOTS – IT LEAVES NO SIGNED ENVELOPES OR BALLOTS THAT HOMEOWNERS CAN USE AS EVIDENCE IN A COURT CASE.
AB2159 also scraps the ability of homeowner to WITNESS the tabulation of votes.
Yes, theoretically, homeowners might be able to retrieve votes cast over the internet – but only by hiring a forensic expert at great cost – which of course defeats the whole purpose of using small claims court.
Furthermore, experts from CalTech, Massachusetts Institute of Technology (MIT), Secretaries of State from California and Arizona, UC Berkeley School of Public Policy, Verified Voting (the tech voting experts) – ALL say that, right now, the technology simply doesn’t exist to make internet voting secure.
- Voter identities can’t be verified (or only at great cost) and, furthermore, can be stolen
- Voting machines can be hacked and the results manipulated by whoever controls the email or website, e.g. the voting vendor or property manager
- It leaves no paper trail to be audited
- And AB2159 cripples the ability of homeowners to challenge elections in small claims court
