Small Claims Master List/First Amendment Rights
Linn v Golden Gate (Contra Costa County)
Case Number R514743221
Synopsis: In this Northern California case, the association repeatedly removed the homeowner’s postings from the community bulletin board, thus blocking her right to communicate with her neighbors. The court ruled that the association’s actions clearly violated the free speech provisions of both the state and federal constitutions. The court also concluded that, because of her ethnicity, the association’s actions also violated California’s fair housing statutes. The court awarded the homeowner $4482+ in damages plus court costs.
