Chaney v. Sun City Roseville Community Association (Placer County)

Synopsis: Don Chaney sued the SCRCA in small claims court to get access to accounting books and records.  The SCRCA challenged his choice of court, arguing that the small claims court had no jurisdiction, because Chaney wasn’t claiming that the SCRCA owed him any money.  The court determined that it had jurisdiction, ordered the HOA to release the records, fined it $500 plus court costs, and issued its findings.



Kochaver v Atchison Village Mutual Homes (Contra Costa County)
Case # RSC06-0208

Synopsis: The homeowner sought HOA minutes and financials.  The board gave her heavily-redacted documents, which the court determined were an unacceptable response to her rights of inspection and copying. She sought $1000 in fines. [Note that the homeowner amended her original SB100 to expand the statutes under which she sued; she also used the small claims subpoena form SB107 and SC104 Proof of Service.]  The court levied $250 + court costs and ordered the release of specific records.
